Vehicle Impoundment
Your vehicle may be impounded for 30 days if the driver at the time of the traffic stop or collision:
- The person driving the vehicle was arrested for Underage DUI, Extreme DUI or Aggravated DUI
- The person driving the vehicle is subject to a certified ignition interlock device requirement and was operating a vehicle without a functioning certified ignition interlock device
- The person driving the vehicle has a revoked or suspended driver's license for any reason or has never been issued a license in Arizona or any other jurisdiction
- The person driving the vehicle has a revoked, suspended or canceled driver's license or has never been issued a license in Arizona or any other jurisdiction and there is no evidence of mandatory insurance and the driver of the vehicle was in an accident with property damage, injury or death of another person
This mandatory impound law applies to the vehicle the offender was driving, even if the driver is not the owner of the vehicle. Additionally, this mandatory impoundment is also separate from any criminal charges filed against the driver.
You only have 10 Days to request a post storage hearing to determine if the vehicle will be eligible for early release.
Post Storage Hearing
The owner, the owner's spouse, the lien holder or other interested party has the right to request a post storage hearing within 10 days from the date towed.
The owner, the owner's spouse, the lien holder or other interested party can obtain an early release if:
- A valid driver's license is presented
- Provide proof of current vehicle registration
- Provide proof of financial responsibility (mandatory vehicle insurance)
- Pay the $150 Administrative Fee
- Sign an "Agreement of Operation"
- Provide proof that a certified ignition interlock has been installed on the impounded vehicle, if required to do so by law
Vehicle Release At The End of 30 Day Impoundment Period
Pay the $150 Administrative Fee
The owner, the owner's spouse or agent presents a valid driver's license, proof of current vehicle registration and proof of financial responsibility (mandatory vehicle insurance)
Provide proof that a certified ignition interlock has been installed on the impounded vehicle, if required to do so by law
Storage Charges For Impounded Vehicle
Not to exceed $15.00 for each day of storage
Include all immobilization, towing and storage fees
The owner of the vehicle is liable for all towing fees and storage charges, unless it is found that the vehicle was improperly impounded.
